All criminal charges are an attempt to curtail your freedom. From small ordinance violations and misdemeanors, which may, realistically, end up with probation, to serious felonies where the government seeks to put you in a cage. Even traffic violations are a way for the government to keep track of you and decide when you’re no longer allowed to drive. It is all about the government keeping tabs on you and stopping you from living your life free of its influence.

However, you have rights when charged with a crime. You need someone to assure those rights are used to protect you from the government. You need someone with the knowledge, and temperament, to fight the government on your behalf.

Felonies

A felony is a crime that is punishable by at least one year (on probation or in prison, depending). Generally, sentences of confinement for felonies are served in prison. There are many crimes that are felonies, including theft, drugs, sex crimes, and violent crime. Felonies have additional consequences that can wreak havoc on your life, and rob you of rights that you previously had. It’s absolutely imperative that you have experienced and competent representation if you’ve been charged with a felony.


Misdemeanors

Misdemeanors are crimes that are punishable by up to 12 months in confinement (jail). Sentences for misdemeanors are written in terms of months, and are generally served in the county jail. Common misdemeanors include domestic violence, DUI, marijuana charges, theft, battery, assault, and traffic violations.


Traffic Violations

In Georgia, traffic violations are misdemeanors (see above). While they usually resolve in ways that don’t require any imprisonment or even probation, this gives them some unique facets. Theoretically, you could have a full-on jury trial about whether you failed to stop at a stop sign, or whether you signaled properly before changing lanes.


Probation Violations

If the government alleges a violation of probation, the defendant is generally entitled to due process. Not all of the rights are the same as when you’re accused of a new crime, but there are important rights before they can revoke probation. Probation violations range from small, technical violations, to allegations that a new serious crime has been committed. Determinations about probation violations generally happen quickly though, so make sure to contact us before it’s too late.
